BELGRADE LAW PROFESSORS' VERDICT

In their aggression against the law and justice, NATO&Soros clerks in the so-called "International Criminal Tribunal for Former Yugoslavia" based in the Hague, decided to ignore, as essentially unpleasant for their dirty work, the initiative of leading law experts and law professors of Belgrade University to appear in the court room as real AMICI CURIAE (in its real meaning - as FRIENDS OF JUSTICE) and expose monstrous character of this institution, for long time successfully hidden from public. Instead, they have appointed three attorneys (from Holland, England and Yugoslavia), proven as real FRIENDS OF (WHITE) HOUSE, to serve as quasidefense for president Milosevic. That way their attempted trial of president Milosevic would become the greatest political FARCE ever seen. Belgrade professors already condemned in press conference such illegal and absurd decision of both "Tribunal" and those three attorneys. Accepting such a role they should lose their licenses, Belgrade professors stated.

For the sake of justice, the full text of the initiative of Belgrade law professors, is hereby given.

The Professors and Assistant Lecturers of the Faculty of Law of the University of Belgrade have been following with great attention the work of the International Tribunal for the prosecution of persons responsible for serious violations of international humanitarian law committed in the territory of the former Yugoslavia since 1991, as the institution that, by a number of elements, is new and specific and all the more interesting therefore from the purely theoretical standpoint and then also as an organ whose work will strongly affect the current and future situation in the space of our country and the situation throughout the region.

In Memory of Corin Ismali

The Western media gives the impression that all Kosovo Albanians hate Serbs and want to live in an ethnically pure state. In fact, many ethnic Albanians were and remain loyal to the concept of Yugoslavia. One such man was Corin Ismali, Secretary of the Kosovo Democratic Initiative.

After NATO and the Kosovo Liberation Army (KLA) seized control of Kosovo in June of 1999, Mr. Ismali and other loyalist leaders were subjected to attacks and death-threats. For a time he left Kosovo. Then, despite the threats, he returned.

This past weekend in Kosovo he was murdered in cold blood. NATO and the UN are guilty, just as sure as if they'd pulled the trigger.

on The Illegitimacy of The Hague 'Tribunal'

[30 August 2001]

There are three fatal legal flaws in the so-called International Criminal Tribunal for the Former Yugoslavia. Each has disastrous consequences for the human quest for peace, the rule of law, democracy, truth and justice.

1. The Charter of the United Nations Does Not Empower the Security Council to Create a Criminal Court

The U.N. Security Council has seized power it does not possess, corrupting the Charter of the United Nations, placing itself above the law and threatening "We Peoples of the United Nations" with a lawless future in which a superpower employs the scourge of war to have its way. Nothing in the history of the planning, drafting, discussion, approval or ratifications of the U.N. Charter implies, or is consistent with, an intention to empower any body created by, or under, the Charter to establish any criminal tribunal. The words of the Charter and their textual inferences, the structure and allocation of power and duties, including those in the incorporated Statute for the International Court of Justice, all negate the existence of any capacity under the Charter to ordain criminal courts. The Criminal Tribunal for Former Yugoslavia is illegitimate and its creation a corruption of the United Nations.

There would never have been a United Nations if its Charter stated, or implied, that a criminal court could be created under its authority. No one who believes in historical truth, or that words have meaning can, after examining the history of its creation and its text, contend that the Charter of the United Nations empowers the Security Council to create a criminal court.

NATO's Tribunal: Straight From the Horse's Mouth

NATO spokesman Jamie Shea at a May 17, 1999 press conference, commenting on the possibility that Louise Arbour, then The Hague 'tribunal's' chief Prosecutor, might consider 'indicting' people not picked by NATO.

Why is NATO Decimating the Balkans and Trying to Force Milosevic to Surrender?

...During the past 14 years, Yugoslav loyalists and their leaders, especially the Serbian people and President Milosevic and his associates, have achieved the same thing the Serbs achieved in 1941.

It was in March of that year that the Serbs overthrew their pro-German government. In a rage, Hitler ordered the conquest of Yugoslavia. His troops got bogged down in the attempt. This delayed Operation Barbarossa, the invasion of the Soviet Union. Because of the Serbs, the Nazi supermen were trapped in the fierce Russian winter.

In 1987, the forces around Milosevic defeated pro-NATO elements in the Serbian government, thus declaring their independence from Washington. From that time on, Milosevic and the Serbian and other Yugoslav loyalists have provided a roadblock obstructing NATO's Drive to the East and a beacon to the former Soviets, to resist.

'Mr. Milosevic Is On The Line'

"Former Yugoslav president Slobodan Milosevic shocked staff at an American television station by telephoning them from The Hague and giving a live interview on air. It is the first time the ex-leader has spoken publicly since his detention on war crimes charges. He claimed he had been a victim of Western propaganda and always acted in the interests of peace.

"'Of course they have no evidence. They cannot have evidence for things that never happened,' he said. 'But this so-called tribunal has one specific characteristic. They are able to fabricate the evidence.'"

Needless to say, this dangerous material was still being censored and had not yet been turned over to the President two days after his birthday

THE FULL TREATMENT

When former Yugoslav President Slobodan Milosevic appeared before The Hague Tribunal on July 2, Judge Richard May told him (and the world):

'You will be accorded the full rights of the accused, according to international law, '

One analyst asked: What are the rights of a kidnap victim under international law?

Now, after six weeks, The Hague 'Tribunal' has provided the following answers:

1) The right to isolation. President Milosevic has been held in solitary confinement for six weeks despite his protest and the official UN position, that: "Efforts addressed to the abolition of solitary confinement as a punishment, or to the restriction of its use, should be undertaken and encouraged." 2) The right not to sleep. During the first several days, the lights were never turned off in Milosevic's cell. As a corollary, video cameras are trained on Milosevic at all times, thus providing the right to no privacy

3) The right to be denied counsel of your choice. After weeks of haggling, one of Mr. Milosevic's Yugoslav attorneys has finally been allowed to see him. However, the Dutch government, acting, it says, under instructions from the 'Tribunal,' has denied the other Yugoslav attorney a visa.

4) The right to witness the mistreatment of your loved ones. Mr. Milosevic's wife is treated like a criminal when she comes to Holland, confined to a hotel room when not visiting her husband from whom she is separated by a plane of glass. (Thus the Tribunal, a United Nations organization, expresses the UN's declared goal that: "All prisoners shall be treated with the respect due to their inherent dignity and value as human beings.")

Lawyers Barred from Seeing Pres. Milosevic Milosevic Attorney Chris Black Details History of Offenses and Broken Agreements in Letter to 'War Crimes Tribunal'

In his August 4th letter to The Hague 'Tribunal,' Attorney Black writes:

"When I met with [ICTY official] Mr. Rohde on the morning of July 9th in order to obtain permission to see President Milosevic who had requested to see me I was met initially with a refusal on the grounds that President Milosevic had decided not to have counsel. However I was assured that if President Milosevic advised the Registrar that he wished to consult with counsel that would be permitted and that such visits would be confidential. At that meeting I was accompanied by Professor André Tremblay, professor of law at the University of Montréal and former senior adviser to Robert Bourassa, Premier of Québec.

"As there was some confusion at that point as to what President Milosevic had actually told the Registry I agreed to accept Mr. Rohde's offer of permission to see President Milosevic on a monitored basis. However, it was clear to myself and Professor Tremblay that it was established that visits by counsel on a confidential basis would be permitted if President Milosevic so requested.

"In my meeting with President Milosevic he was advised of his need to request to see counsel in order to meet with them on a confidential basis and that this was the position taken by Mr. Rohde. Acting on this information and advice, he subsequently requested to see several counsel."

Ramsey Clark Slams Hague 'Tribunal'

[Nico Varkevisser is Coordinator of the International Committee to Defend Slobodan Milosevic in Netherlands.]

Yesterday the ICDSM held another press conference in Amsterdam. The press was addressed by Ramsey Clark, former Attorney General of the USA and Co-Chairman of the ICDSM. Mr. Clark had spent the better part of three days meeting with President Slobodan Milosevic, imprisoned in The Hague.

Posted below is a surprisingly accurate 'Reuters' dispatch covering the press conference. I say 'surprisingly accurate' because three days ago 'Reuters' declared, as if repeating an accepted fact, that Milosevic:

"...remains in solitary confinement at his own request." ('Reuters,' 31 July 2001)

Contradicting this lie, Attorney Clark most strongly protested the fact that...

Defend Macedonia Against Terror and Separatism

The Socialist Party of Serbia condemns the escalation of violent separatism against our neighbor, Macedonia, caused by the organized spread of the terrorism of the so-called Kosovo Liberation Army (KLA) to Macedonia and southern Serbian municipalities. This is due to the systematic violation of Security Council Resolution 1244, especially the failure [by NATO] to fulfil its obligation to disarm terrorists, and due to support for the KLA by NATO structures. The aim is to create Greater Albania, to change internationally recognized borders to the detriment of Serbia and Yugoslavia, of Macedonia and of Greece. This is leading towards deepening instability in the Balkans and threatens the stability of the entire Mediterranean area.

How is one to describe it?

The other day, Slobodan Milosevic, who has a genius for brevity, called it a 'genocidal circus.' Should the powers-that-be have allowed this confrontation to be televised? On the one hand, a modest man, genuine, smart, accusing his accusers; on the other hand, a sugary nightmare of Empire.

Now that Americans run the world, they like to wheel out a Brit sometimes for effect ("they got class, you know") but it wasn't enough. At least two times 'Judge' Richard May, 'Chairman' of the 'Tribunal,' (in the New World Unreality, one is driven to quotation marks...) was witnessed by 300 million viewers cutting Slobodan Milosevic's microphone.

Their common view is that Kostunica was out of the loop; that the kidnapping was a big surprise or even an attack on him by Serbian Prime Minister Djindjic.

"What follows is taken from the Hague 'Tribunal's' rules covering detention, visits and communications. Another piece, covering procedures and evidence will follow. This newspaper has no connection with the Belgrade 'Telegraph' which published a transcript of an alleged phone conversation between Serbian Prime Minister Djindjic and Yugoslav President Kostunica before they illegally kidnapped President Milosevic.

The London 'Telegraph' article is educational for it demonstrates the extent to which the media spreads pro-Washington misinformation about the Serbian people in general and Slobodan Milosevic in particular.

Sinds Slobodan Milosevic besloot om zich vrijwillig te onderwerpen aan wat in zijn ogen en die van veel andere mensen een door de Amerikanen opgelegde arrestatie was, is een nieuw thema opgedoken in de pers. Simpel gezegd: 'Milosevic is suïcidaal'. Dit is nogal onheilspellend. Milosevic vertegenwoordigt de krachten in Servië die zich verzetten tegen de Verenigde Staten. Dit is een vaststaand feit, dat losstaat van het feit of je Milosevic 'mag' of 'niet mag'.

Ik maakte deel uit van een groep van drie mensen die twee en een half uur met president Milosevic hebben gesproken, nadat we een congres in Servië hadden bijgewoond. William Spring has sent by fax a letter to Geoff Hoon MP, Secretary of State for Defence, a copy of which is pasted below.

He requests Geoff Hoon to provide him with names of those involved in the decision making process to transport Slobodan Milosevic to The Netherlands, & says those involved have engaged in an illegal act under UK law, the crime of kidnapping.

"I am framing an indictment. I hope for legal aid so the indictment can be settled by counsel, but because of the urgency will frame my own indictment if legal aid is not forthcoming soon.

"The Magistrate is required to sign the indictment, but will not hear the case. It should then be remitted to the Crown Court.

"The government will probably plead The Royal Prerogative as a defence, but at least I hope to get them into Court this time.

Last time, May 99, when I sought to summon Tony Blair, Lloyd Axworthy, Albright, Holbrooke & co to Highgate Magistrates Court alleging conspiracy to cause explosions & murder people in the Federal Republic of Yugoslavia in contravention of an 1861 Act the Magistrate refused to issue the summons, in violation of the law."

Letter To The Editor Of New York Times By Professor Raymond K. Kent Of University Of California

In reference to "Milosevic and the Beginning of Honesty," I applaud the part of Peter Maass' Op-Ed essay where he recommends that Serb judges be included and that Serb journalists be helped to report on the Hague tribunal's proceedings in order to make the verdict convincing to the Serbs. I do so because Carla del Ponte has already condemned Milosevic in public for life in prison without a trial, with additional charges beyond Kosovo. Under such a circumstance she needs to recuse herself from prosecuting the man she has already sentenced and a new prosecutor is in order. It is not only that Milosevic is on trial but, also, the Tribunal itself. It has so far been unable to provide absolute public evidence of a single fair and impartial trial. An open trial, with full defense rights and with a new prosecutor would provide the needed environment for a verdict that all can accept. Otherwise the Rule of Law which the International Community has sought to promote in the Balkans, will have no future. This is already evident in the way that Milosevic was delivered to the Hague in an RAF plane in clear violation of the Rule of Law in Belgrade itself.

Several representatives of the political parties and NGOs met in New Delhi in an emergency meeting convened by the National Panthers Party President, Prof. Bhim Singh to review the situation created following the illegal detention and extradition of Mr. Slobodan Milosevic, former President of Yugoslavia. RAF AIR CREW MINISTERS & COMMANDERS TO BE INDICTED IN UK COURTS FOR KIDNAPPING

I have just heard on BBC television that the former head of state of the Federal Republic of Yugoslavia, Slobodan Milosevic, has been transported to Holland by an RAF plane.

If this proves to be true, later today I will be visiting the British Ministry of Defence to ask for the names of the pilots & air crew of the aircraft involved, so that their names can be included in an indictment I plan to lodge at the Crown Court on the charge of kidnapping.

If the MOD refuse to give me these names, I will instead proceed against the appropriate Minister, senior civil servants & RAF commanders, whose names are known, & who gave the orders & acted as accomplices in the illegal abduction of a foreign national.

I hope others might consider other moves, such as applying for a writ of Habeas Corpus, but such a writ would have to be directed I presume against the Dutch authorities.

What Britain has done & Mr Tony Blair has endorsed is a loathsome act of international brigandage.

WONDERFUL LETTER FROM 'CAMPEACE'

Dear friends,

I received tonight the email posted below. It is from Cambridge Campaign for Peace (CAMPEACE). It takes a strong stand against the EXTRADITION DECREE that was just illegally 'passed' by some of the Ministers of the Yugoslav government, in defiance of a Parliamentary majority and under orders from Washington.

The authors say they are not supporters of Mr. Milosevic and I say: then good for them that they realize the issue with this decree is Yugoslavia's existence.

The issue is the Serbian people's very survival. LET US ALL UNITE- however we feel about Mr. Milosevic - to defend Yugoslav sovereignty, to defend the Serbian people, which means to defend all of us, and especially all small and medium sized nations everywhere, from NATO destruction of sovereignty, and war.

I hope a petition can be produced as soon as possible that takes the sort of position stated by the Cambridge Peace people and which says "However we feel about Mr. Milosevic - for him, against him, or none of the above - we are united to defend Yugoslavia from this total assault on its sovereignty." Something like that.

The other thing we need - and we need it now - is public action!

As Vice Chairman of the International Committee to Defend Slobodan Milosevic (ICDSM) I can say this: the ICDSM will aid any effort to oppose this illegal decree.

We need demonstrations!

It is very important now for people with international reputations to go to Belgrade and speak out.

Committee Backing Milosevic Warns Against Extradition To ICTY

BELGRADE -- An official of an international committee set up to defend Slobodan Milosevic Thursday warned of catastrophic consequences for Yugoslavia if the former president is handed over to the UN war crimes tribunal in The Hague.
"Be sure that misery, poverty, famine and total destruction would prevail in the country" if Milosevic is sent to The Hague, said Mikhail Kuznecov, deputy chairman of the International Committee for the Defense of Slobodan Milosevic.
"Do not have any illusions that the United States or NATO will give you money and help you rebuild your economy?" he told reporters.

The KLA attack could not have taken place if it were not sponsored by NATO, led by Washington. We urge people everywhere: defend FYROM from the international smear campaign which has been launched by the Western mass media and so-called human rights groups.
NATO always claimed that ethnic conflict in the Balkans was the work of Mr. Milosevic and the Yugoslav government. But Mr. Milosevic has been illegally jailed for 10 weeks. And the Yugoslav government is now pro-NATO.

SOCIALISTS PROTESTED
Saturday June, 16th

Fifty thousand people gathered in the center of Belgrade on Saturday to attend a rally organized by the Socialist Party of Serbia.
Socialist party top brass spoke at the rally, titled "Against the Hague - For Kosovo in Serbia - For a Free Serbia - For a free Slobodan".
Branislav Ivkovic accused the Democratic Opposition of Serbia of bargaining with the international community about the price of extraditing the former Yugoslav president.

The majority of those who were attending the protest meeting were young people and students who are disappointed with the current Serbian government and degradation of Serbian traditional values such as pride, heroism, and freedom.

After the rally, the crowd went to the Belgrade Central Prison and was joined there by several thousand encouraging citizens. Together they chanted "We want Sloba".

Federal Assembly Commission Supported Appeal For Slobodan Milosevic Medical Treatment Out Of Prison

Commission for applications and suggestions of the Federal Assembly supported the appeal of 20 medical doctors, members of Assembly who are demanding medical treatment out of prison for Slobodan Milosevic. This treatment is supposed to be held in highly specialized medical institution. According to Fonet, this appeal that was sent to authorities of Serbia and FRY, medical experts and public was supported by 4 members of commission, one was against it, and one was detached. Commission didn't support suggestion for previous opinion from prison and Military Medical Academy experts. Commission evaluated this appeal as "human and sustainable".

Since this petition was written President Milosevic has been kidnapped in violation of the Yugoslav constitution and international law by authorities in Belgrade. He has been delivered by the RAF and Dutch authorities to NATO's Tribunal in The Hague. The signers of this petition most strongly demand that President Milosevic be immediately released from illegal detention and that he be returned a free man to his country and his family.

We the undersigned demand that the Serbian authorities immediately release Slobodan Milosevic and all other Serbian patriots from jail.

The arrest of Mr. Milosevic is an attempt by NATO leaders to blame the Serbian people for crimes against Yugoslavia committed by NATO.
